Περιγραφή

Ιστορική αναδρομή στην οργάνωση της Διεθνούς Κοινωνίας. Γενική Θεωρία: περί διεθνών οργανισμών. Ορισμός, σύσταση διεθνούς οργανισμού, νομικό καθεστώς που διέπει τους διεθνείς οργανισμούς, ιδιότητα μέλους, θεσμική διάρθρωση, αυτόνομη βούληση, λόγοι διάλυσης διεθνούς οργανισμού, διακρίσεις διεθνών οργανισμών. Παγκόσμιοι Οργανισμοί: Το σύστημα των Ηνωμένων Εθνών, ΟΗΕ, Βοηθητικά Όργανα και Αυτόνομοι Οργανισμοί, Ειδικευμένες Οργανώσεις, Ειδικές Οργανώσεις συνεργαζόμενες με τον ΟΗΕ. Περιφερειακοί Οργανισμοί. Ευρωπαϊκοί Οργανισμοί: Πολιτικοί (Συμβούλιο Ευρώπης-Βόρειο Συμβούλιο). Πολιτικοστρατιωτικοί (ΝΑΤΟ, ΟΑΣΕ). Οικονομικοί ( ΕΖΕΣ - Βenelux - ΟΟΣΑ - Οικονομική Συνεργασία Μαύρης Θάλασσας (ΟΣΕΠ)). Η Ευρωπαϊκή Ένωση: Νέο μόρφωμα στο Διεθνές Σύστημα. Αμερικανικοί Οργανισμοί, Αφρικανικοί Οργανισμοί, Οργανώσεις Νοτιανατολικής Ασίας. Ο κάθε Οργανισμός εξετάζεται κάτω από 5 θεματικές: (1) Ιστορικά, (2) Ιδρυτική Συνθήκη, (3) Μέλη, (4) Θεσμική Δομή, (5) Δραστηριότητες.

Περιγραφή

Ορισμός και θεωρία του Διεθνούς Δικαίου. Τα υποκείμενα του διεθνούς δικαίου. Σχέσεις διεθνούς και εσωτερικού δικαίου. Πηγές διεθνούς δικαίου: Έθιμο, γενικό καθεστώς - λειτουργικότητα. Διεθνείς συνθήκες. Σύναψη διεθνών συνθηκών, επιφυλάξεις στις διεθνείς συνθήκες, αποτελέσματα των διεθνών συνθηκών μεταξύ συμβαλλομένων μερών και ως προς τρίτους. Ερμηνεία συνθηκών, αναθεώρηση, λήξη ή αναστολή ισχύος, απρόβλεπτη μεταβολή συνθηκών, ακυρότητα - Οι γενικές αρχές του δικαίου. Οι επικουρικές πηγές. Κράτος και έδαφος. Εδαφική κυριαρχία. Τρόποι κτήσης εδάφους. Περιορισμοί εδαφικής ακεραιότητας. Ομοσπονδίες κρατών - ομόσπονδα κράτη. Το κράτος στη διεθνή κοινότητα - αναγνώριση, διαδοχή κρατών. Διεθνής ευθύνη, διπλωματική προστασία. Ειρηνική επίλυση των διαφορών. Δίκαιο θάλασσας.

Προσδοκώμενα Μαθησιακά αποτελέσματα

- Αντίληψη των πτυχών της διεθνούς συνεργασίας, χάραξης (εξωτερικής) πολιτικής και επίλυσης διαφορών μέσω του διεθνούς δικαίου και των διεθνών οργανισμών.

- Ανταπόκριση με κριτική ικανότητα σε ζητήματα που σχετίζονται με τη δικαιοπαραγωγική διαδικασία του διεθνούς δικαίου.

- Κατανόηση των μεθοδολογικών, επιστημονικών και πολιτικών παραμέτρων ως προς την αποστολή, τις δομές και τις λειτουργίες του διεθνούς δικαίου και των διεθνών οργανισμών.

Γενικά περί διπλωματίας. Η διπλωματία σε ιστορική εξέλιξη. Η ιδιότητα του διπλωμάτη: προϋποθέσεις κατά το ελληνικό δίκαιο. Οι πηγές του διπλωματικού δικαίου: έθιμο, διεθνείς συμβάσεις, εσωτερικό δίκαιο. Οι διακρατικές διπλωματικές σχέσεις. Έναρξη των διπλωματικών σχέσεων. Καθήκοντα της διπλωματικής αποστολής. Προνόμια και ασυλίες των διπλωματών. Persona non grata: Τερματισμός των διπλωματικών σχέσεων. Προξενικές σχέσεις. Το διεθνές καθεστώς των προξένων. Διαφορές μεταξύ προξένων και διπλωματών. Αποστολή προξένων. Προνόμια και ασυλίες. Οι ειδικές αποστολές. Η διεθνής προστασία των διπλωματών με ειδικές συμβάσεις.
